Welcome to HOD Media. These Terms & Conditions ("Terms") govern your use of our website hodmedia.in and the services we provide. By accessing our website or using our services, you agree to these Terms.

1. About Us

HOD Media ("we", "us", "our") is a digital marketing and ecommerce solutions provider operating from Ahmedabad and Amreli, Gujarat, India. We provide Meta Ads management, WhatsApp lead generation, creative design, branding, and an ecommerce store platform.

2. Services

We offer:

  • Digital marketing services (Meta Ads, WhatsApp marketing, content creation, branding)
  • An ecommerce SaaS platform allowing merchants to create and operate online stores

Service features and pricing are described on our website and may be updated from time to time.

3. Accounts & Registration

  • You must provide accurate, complete information when registering.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity under your account.
  • You must be at least 18 years old to use our services.

4. Payments & Billing

  • Marketing service fees and platform subscription fees are as listed on our website.
  • Ecommerce platform plans are billed monthly (₹299) or yearly (₹2,499) as selected.
  • For Meta Ads services, advertising spend (ad budget) is always shown and charged separately from our service fees, and our fee structure is disclosed to you before you pay. Campaign reporting we show you uses Meta's own metrics and terminology and is reported separately from any other advertising platform.
  • All fees are in Indian Rupees (INR) and exclusive of applicable taxes unless stated.
  • Payments are processed securely through third-party gateways (Zoho Payments, Razorpay, PayU, Cashfree).
  • Subscription plans renew automatically unless cancelled before the renewal date.

5. Cancellations & Plan Changes

  • Monthly plans may be cancelled at any time; cancellation takes effect at the end of the current billing period.
  • Yearly plans are billed once for the full year.
  • Upon cancellation or expiry, your store will be paused; your data is retained per our Privacy Policy.
  • Stores that have never taken an order and never paid for a plan are archived after 60 days of complete inactivity and deleted after 120 days, with email warnings beforehand. Signing in stops this at any stage — see “Data Retention” in our Privacy Policy for the full schedule.

6. Advertising Services & Meta Platform Compliance

When we run advertising campaigns for you on Meta platforms:

  • All campaigns are subject to Meta's Advertising Standards, Meta's Terms of Service, and applicable supplemental terms, and you agree to comply with them.
  • Ad content must be truthful. We review every campaign before it goes live and will decline or require changes to creatives or copy that make misleading, deceptive, exaggerated, or unsubstantiated claims (including unrealistic results, prices, discounts, or health and earnings claims), or that otherwise violate Meta's Advertising Standards or applicable law. You are responsible for being able to substantiate every claim in your ads.
  • Leads generated through your campaigns may be used only to contact the person about the specific product or service they enquired about. You must honour opt-out requests immediately and comply with laws applicable to your communications.
  • We process data received from Meta ("Platform Data") in accordance with Meta's Platform Terms and our Privacy Policy. Each client's campaign data is kept separate, used only on an aggregate, anonymous basis to assess campaign performance, and never sold or used to build user profiles.
  • Meta may reject, pause, or remove ads at its discretion; advertising results are not guaranteed and platform decisions are outside our control.

7. Merchant Responsibilities (Ecommerce Platform)

If you operate a store on our platform, you are solely responsible for:

  • The products and services you sell and their legality
  • Accurate product descriptions, pricing, and fulfilment
  • Your own customer service, shipping, returns, and refunds to your customers
  • Compliance with applicable laws including GST, consumer protection, and product regulations
  • Obtaining your own payment gateway and complying with its terms

8. Acceptable Use

You may not use our services to:

  • Sell illegal, counterfeit, or prohibited goods
  • Violate any laws or third-party rights
  • Transmit malware, spam, or harmful content
  • Infringe intellectual property rights
  • Engage in fraudulent or deceptive practices
  • Publish or advertise false, misleading, or unsubstantiated claims about products, prices, discounts, results, or endorsements
  • Misrepresent your identity or business, or impersonate any person or brand

9. Intellectual Property

All content, designs, logos, and software on hodmedia.in are owned by HOD Media or its licensors. Creative work produced for clients remains subject to the terms of the specific service agreement.

10. Third-Party Services

Our services integrate with third parties (Meta/Facebook, payment gateways, etc.). We are not responsible for their performance, policies, or availability. Your use of those platforms through our services is additionally governed by their own terms and policies.

11. Limitation of Liability

Our services are provided "as is". We do not guarantee specific results from advertising campaigns. To the maximum extent permitted by law, HOD Media is not liable for indirect, incidental, or consequential damages.

12. Termination

We may suspend or terminate accounts that violate these Terms or for non-payment. We may also archive and eventually delete a store that has never been used, as described in section 5 and in our Privacy Policy. You may close your account and request deletion of your store at any time by writing to [email protected].

13. Changes to Terms

We may update these Terms at any time. Continued use of our services constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of India. Disputes are subject to the jurisdiction of the courts of Ahmedabad, Gujarat.
